Short answer: price the flat against recent sales in your society, keep the title papers, society no-dues and loan details ready, take a token with a written receipt, sign an agreement to sell, then complete the sale deed at the sub-registrar's office. Once a buyer is found, the paperwork usually takes three to eight weeks.

1. Price it on real sales, not asking prices

Listing portals show what owners are asking, not what buyers paid. Ask a local dealer for recent closed deals in your society or sector, and compare like with like: floor, facing, view, furnishing and parking. Also check the circle rate for your sector, because buyers' stamp duty is charged on whichever is higher.

2. Keep these documents ready

  • Your sale deed or conveyance deed, and the earlier chain of deeds
  • Allotment letter, builder-buyer agreement and possession letter (for a flat bought from a builder)
  • Occupation certificate of the building, if available
  • Society no-dues and the society's transfer requirements
  • Latest property tax receipt, electricity and water bills
  • Home loan statement and the bank's foreclosure figure, if there is a loan
  • PAN and Aadhaar of every owner on the deed

Buyers' lawyers will ask for exactly these, using a checklist like ours. Having them ready is the single biggest thing that speeds up a sale.

3. Make the flat easy to show

Fix leaks, repaint scuffed walls, clear clutter and replace dead bulbs. Good daylight photographs bring in more serious enquiries than any description. If the flat is rented, agree viewing times with the tenant in advance.

4. Token and agreement to sell

  • Take the token amount by bank transfer, never in cash, with a written receipt that names the flat, the agreed price and the date by which the agreement will be signed.
  • The agreement to sell sets out the price, the payment schedule, the date of registration, who pays which charges, and what happens if either side backs out.

5. Loan closure and registration

If you have a loan, the buyer's payment clears it first and your bank releases the original documents. At registration, both parties and two witnesses attend the sub-registrar's office. The buyer pays the stamp duty and registration fee, and you hand over the originals and keys after the full payment is received.

6. After the sale

  • Apply for the society transfer and hand over parking stickers and access cards.
  • Transfer or close the electricity and water connections.
  • Keep a copy of the registered deed for your capital gains tax filing, and speak to a chartered accountant.

Frequently asked questions

How long does it take to sell a flat in Gurugram?

It varies with price and location. Once a buyer is found, the paperwork from token to registration commonly takes three to eight weeks, and longer if the buyer needs a home loan or your own loan has to be closed first.

Can I sell a flat that still has a home loan?

Yes. The buyer's payment, or the buyer's bank, first clears your outstanding loan. Your bank then issues a closure letter and returns the original documents, which are handed over at registration.

Who pays the stamp duty when a flat is sold?

In Gurugram the buyer normally pays the stamp duty and registration fee. The seller pays their own costs, such as loan closure, any brokerage agreed with their dealer, and capital gains tax.

Do I have to pay tax when I sell my flat?

If you make a profit, capital gains tax may apply, and the rules depend on how long you held the property. Some exemptions are available if you reinvest. Speak to a chartered accountant before you sign, because the timing of the sale can change the tax.
